Can You Serve Notice Without Right to Rent Checks?

Hi, We issued a 12-month tenancy in 2019 that has remained rolling. This is an unmanaged property; therefore, the Landlord has not carried out the mandatory Rights to rent checks since this came into force. Can he still serve the notice without having checked this recently?
