Types of Tenancy - Contractual Tenancies

A contractual tenancy is often also known as a common-law tenancy. This type of tenancy is used in certain circumstances where a tenancy cannot be an assured shorthold tenancy. Examples include:

  • any of the tenants are NOT individuals (e.g. company let)
  • the dwelling is NOT to be the tenant’s only or principal home
  • the rent exceeds £100k per annum
  • the landlord is a resident landlord, living in a part of the same building, which is not a purpose-built block of flats (but not a lodger where accommodation is being shared with the landlord).
